What Are Fiancé Visas (K1, K2 & K3)? I help people obtain fiancé and marriage visas. These visas are known as K1 and K3 Visas. Many of the visas we obtain are for Ukrainian and Russian fiancés, although we certainly handle visas for people living in countries all over the world. The K1 Fiancé Visa is the legally proper visa to use for a person who lives outside the United States who seeks to enter the U.S. for purposes of marriage. K1 visas are generally valid for a period of 3 months or 90 days. The K2 visa allows a child of your fiancé to enter the U.S. and stay while the fiancé is in the U.S. The K3 Visa is what is used for an immigrant spouse. In other words, the couple married outside of the United States and the foreign party is seeking entry into the U.S. to live with their spouse who is a U.S. citizen. Other visas such as a Student Visa or Work Visa may be obtained for a fiancé’s entry, but ultimately a K3 Visa will be needed in order for the person to remain in the United States. Although it may be initially more timely to obtain a visa other than a K1, the end result will be more costly as more than one visa will need to be obtained. |

Which Is Better - K1 or K3?
By now you understand that a K1 visa is used when the fiancé is coming into the U.S. with the anticipated marriage occurring within 3 months or 90 days of the fiancé’s arrival. The K3 visa is for a couple that married outside of the U.S. The question then becomes, which is the best route to take?
The K1 offers the couple the chance to get to know each other, instead of a rushed or speedy marriage. This offers the fiancé a little more time to become more familiar with the U.S. culture. The fiancé has a chance to visit the country and become more familiar with the language. Here, you are working with U.S. immigration officials as opposed to the uncertain and unpredictable laws of a foreign country. However, notwithstanding the advantages, the K1 visa is going to require the fiancé to prove their case before the U.S. Embassy that the intentions of marriage are serious and that love is, in fact, the motivating factor for obtaining the visa. Obviously, if the marriage occurs in the U.S. then the fiancé’s family will most likely not be able to attend.
As far as the K3 visa is concerned, the reality is that the marriage is immediate. Your fiancé’s family will be able to attend the wedding, since it will take place in their country. Most countries have somewhat easy procedures for marriage, so the ceremony can take place rather quickly. Your fiancé immediately gains residency into the U.S. so the process time is reduced considerably. Furthermore, a “green card” or an adjustment to his or her status is not required, like it would be for a K1 visa. However, other requirements make this route burdensome. For example, documentation is still required from the U.S. citizen to marry in a foreign country. Next, you are required to file two sets of applications - one form called an I-130 followed by the filing of an I-129F. Documents require translation, which must be done properly. Finally, any mistakes along the way can result in considerable delays. |

This packet has all the important documents needed for your fiancé’s visa. We will subsequently file on your behalf what is called an I-129F Petition. Also, we will make sure you have all the supporting documentation, as required by the current law in effect. As part of our package, we will have someone from our staff coordinate and speak with your fiancé in her native language. Our staff will contact your fiancé and make sure she understands everything that will be needed from her. We will basically “hold his or her hand” along the way and make sure they are comfortable during the process of obtaining the fiancé visa. We will even mail your fiancé all the required forms so that your fiancé will be prepared before the Embassy contacts him or her. This will help to ensure that the process is completed quickly and efficiently. Prior to your fiancé going in for his or her meeting with the Embassy, we will apprise them on what exactly will be taking place during the interview. Third, after we are convinced that we have the proper documentation and information, then we will file your petition in one of the following United States Citizens and Immigration Services (USCIS) offices: California Center, Vermont Center, Texas Center or the Nebraska Center. Our primary goal is to work out any anticipated problems before the petition is filed. Saving you time is our number one priority.
